Judge Molly Johnson of Mahoning County Area Court in Canfield ruled on a motion by the attorney for Patrick Havas, 38, who faces two counts of assault, a first-degree misdemeanor; inducing panic, also a first-degree misdemeanor; and disorderly conduct, a minor misdemeanor; for a Sept. 6 incident at the fair while Acton was in a tent for the Democratic Party.
